Terms of Service

Welcome to Neat Fence LLC (“Neat Fence,” “Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website www.neatfence.com and any services provided by Neat Fence LLC.

By accessing our website or engaging our services, you agree to these Terms.

1. Services Provided

Neat Fence LLC provides installation and related services including, but not limited to:

  • Residential and commercial fencing
  • Railingsu
  • Pergolas
  • Outdoor structures
  • Outdoor kitchens
  • Repairs and modifications

All services are subject to written estimates, signed agreements, and availability.

2. Estimates & Contracts

  • All estimates are valid for 30 days, unless otherwise stated.
  • Pricing is subject to material availability and market fluctuations.
  • A signed contract and deposit are required before scheduling installation.
  • Changes to project scope may result in price adjustments via written change order.

3. Deposits & Payments

  • Deposits are required to secure materials and schedule installation.
  • Deposits may be non-refundable once materials are ordered.
  • Final payment is due upon project completion unless otherwise agreed in writing.
  • Late payments may incur interest or collection costs as permitted by law.

Failure to make payment may result in suspension of services.

4. Financing

If financing is offered:

  • Financing is subject to third-party approval.
  • Neat Fence LLC is not responsible for lender decisions or terms.
  • Customers remain responsible for payment obligations under the service agreement.

5. Scheduling & Delays

Installation dates are estimates and may be affected by:

  • Weather conditions
  • Material delays
  • Permit approvals
  • Site conditions
  • Unforeseen circumstances

Neat Fence LLC is not liable for delays outside of our reasonable control.

6. Property Conditions & Utilities

Customer agrees to:

  • Provide clear access to the work area
  • Mark sprinkler systems, invisible fences, and private utilities
  • Ensure pets and children are secured

While we utilize utility locating services (e.g., Miss Dig), Neat Fence LLC is not responsible for unmarked or privately installed underground lines.

7. Materials & Variations

Natural materials such as wood may vary in:

  • Color
  • Grain
  • Texture
  • Warping or movement

These are normal characteristics and not considered defects.

Metal finishes, powder coating, and composite materials may also have slight color variations.

8. Warranties

Manufacturer warranties apply to materials as provided by suppliers.

Workmanship warranties, if offered, will be outlined in your signed contract.

Warranty does not cover:

  • Damage from weather events
  • Acts of God
  • Improper use or modification
  • Lack of maintenance
  • Vehicle or third-party damage

9. Website Use

You agree not to:

  • Use our website for unlawful purposes
  • Attempt to interfere with website security
  • Copy or reproduce content without permission

All content on this site is the property of Neat Fence LLC.

10. Limitation of Liability

To the maximum extent permitted by law:

Neat Fence LLC shall not be liable for indirect, incidental, special, or consequential damages arising from:

  • Use of our website
  • Installation delays
  • Material shortages
  • Project-related disputes

Our total liability shall not exceed the amount paid for the specific project in question.

11. Indemnification

You agree to indemnify and hold harmless Neat Fence LLC from claims arising from:

  • Misuse of installed products
  • Failure to disclose property conditions
  • Unauthorized modifications to completed work

12. Dispute Resolution

Any disputes shall first be attempted to be resolved through good-faith negotiation.

If unresolved, disputes shall be handled in accordance with the laws of the State of Michigan, with venue in the appropriate court serving the county where the project was performed.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Updates will be posted on this page with a revised effective date.
